Consumer Law
Consumer law protects those who acquire goods or services for non-commercial purposes. The available routes differ according to the value of the dispute.
Defective goods and services
Where goods delivered or services supplied do not conform to the contract, the consumer may choose between repair, replacement, a reduction in price or rescission.
Where the defect is latent, the consumer’s rights are assessed by reference to the date the defect was discovered.
Distance contracts and the right of withdrawal
In contracts concluded online or at a distance, the consumer has a right to withdraw without giving reasons. The period for exercising it is set by law.
A seller’s failure to meet its pre-contractual information duty affects when the withdrawal period begins to run.
Routes of application
Depending on the monetary value of the dispute, application is made to a consumer arbitration committee or to a consumer court. The monetary thresholds are revalued annually.
Decisions of an arbitration committee may be challenged before a consumer court.
