Law of Obligations
The law of obligations governs how obligations between persons arise, how they end and what may be claimed when they are breached. It underpins many of the other fields.
Contractual disputes
Claims arising from the formation and interpretation of a contract, and from its non-performance or defective performance, fall within this scope.
Where an obligation is not performed, or not performed properly, claims for specific performance, rescission and damages arise.
Tort and compensation
Where unlawful conduct causes loss to another, pecuniary and non-pecuniary damages may be claimed. Compensation arising from traffic accidents is the most frequent example in this field.
Unjust enrichment is a separate legal basis, providing for the return of gains obtained without lawful cause.
Lease relationships
The formation of a lease, determination and adaptation of rent and claims for eviction are considered here.
The grounds for eviction are exhaustively listed in the law, and identifying the correct ground determines the outcome.
